"It was not handled properly (by the DA's office)," added Catawba County Sheriff L. David Huffman. "If we had had that evidence to use in court, I'm thinking this guy LaBoy would have done some pretty hard time."

"It's like, 'Oops, we destroyed the evidence,"' said Hensley, shown visiting his daughter's grave in Hickory, N.C. "...My girl is dead. She's dead. And all they did was just pat this guy on the back and give him a little more courage to do it again."

A FAVOR FOR A FRIEND
What do campaign contributions and a close friendship with DA Jay Gaither get you?  Well, if you're talking on your cellphone while illegally passing a vehicle on the entrance ramp to I-40 and in turn hit a tractor trailer which causes a major accident killing a man, then it gets you your own special session of court (so as to prevent any unnecessary embarrassment),      NO JAIL TIME, A PRAYER FOR JUDGMENT CONTINUED (PJC) and no insurance points on your license.

North Carolina State Highway Patrols 425 page report concluded "that the proximate cause of this collision and the subsequent death of Billy Ray Parker were both due to Dr. Robert Louis Liljeberg, Jr.'s inattention and failure to yield the right-of-way as he attempted to merge onto I-40.  In addition, Dr. Liljeberg, Jr. willfully left the scene of the collision after he knew or should have known that he was involved in a fatal collision."

When the arresting officer’s supervisor, Chief Kevin Pressley, was asked why DA Jay Gaither was not charged with aiding and abetting a DWI, he responded “we’re not concerned with the passengers in the vehicle in a DWI,” and that it’s the “officer’s discretion” as to whether the owner of the vehicle will be charged with aiding and abetting a DWI.  Read more...
